Family Advising Service Agreement
It is hereby understood that the headings are present for convenience only and shall not affect the interpretation of this agreement. Now therefore in consideration of the mutual covenants set out herein and valuable consideration, the sufficiency of which is hereby acknowledged, the parties hereto agree as follows:
1. Finances:
The ‘Student-athlete’ agrees to pay ‘AHA’ an advising fee for any of the following packages listed below, which shall be payable immediately upon signature of this agreement. ‘AHA’ will provide their services immediately after payment has been received from the ‘Student-athlete’. Should the ‘Student-athlete’ wish to continue their services with ‘AHA’ after their agreement has expired, the ‘Student-athlete’ can renew their current agreement or choose a new financial package that best suits their needs.
The cost is 1199$ for 3 months, 1999$ for 6 months, or 2999$ for 1 year. ‘AHA’ agrees to act as the ‘Student-athlete’s’ mentor and actively promote them to the amateur programs and post-secondary institutions best suited for them, with the long-term goal of getting the ‘Student-athlete’ recruited to play for an NCAA, USports, or ACHA program. ‘AHA’ will keep the ‘Student-athlete’ informed of all important activities; this will include communication from amateur programs and post-secondary institutions, as well as advice with skill development, conditioning, academics, and overall life skills. The ‘Student-athlete’ has unlimited access to ‘AHA’, and ‘AHA’ agrees to return all ‘Student-athlete’ calls and other forms of communication in a reasonable time period as determined by ‘AHA’ in its sole and absolute discretion.
3. Premium Package:
The cost is 4999$ for 1 year. ‘AHA’ agrees to act as the ‘Student-athlete’s’ mentor and actively promote them to the amateur programs and post-secondary institutions best suited for them, with the long-term goal of getting the ‘Student-athlete’ recruited to play for an NCAA, USports, or ACHA program. ‘AHA’ will schedule a 1 hour video meeting for each session with the ‘Student-athlete’ to speak about communication between amateur and post secondary programs, as
well as career trajectory, mindset coaching, game film analysis, or any other hockey related topic the ‘Student-athlete’ wishes to cover. The ‘Student-athlete’ has unlimited 1st priority access to ‘AHA’, and ‘AHA’ agrees to return all ‘Student-athlete’ calls and other forms of communication in a reasonable time period as determined by ‘AHA’ in its sole and absolute discretion. Should the ‘Student-athlete’ require workout plans or highlight videos to be promoted to target programs, ‘AHA’ will create them free of charge for the ‘Student-athlete’ in this package.
4. Eligibility:
‘AHA’ will provide guidance and advice to the ‘Student-athlete’ with regards to academic and athletic requirements to ensure compliance with the NCAA Eligibility Center and the individual institutions to which the ‘Student-athlete’ is applying. For greater certainty, ‘AHA’ is not responsible for, and the ‘Student-athlete’ shall fully indemnify ‘AHA’ with respect to the ‘Student-athlete’s’ compliance with the NCAA Eligibility Center.
5. Autonomy:
‘AHA’ and the ‘Student-athlete’s’ respective advisor will not make decisions for the ‘Student-athlete’, but will rather provide complete disclosure and feedback to him/her and his/her family so they possess the necessary information to be able to make the best possible decisions.
6. Confidentiality: ‘AHA’ agrees to keep all sensitive information that is not public knowledge confidential.
7. Disclosure:
The ‘Student-athlete’ understands and accepts that ‘AHA’ cannot guarantee placement or a commitment to any programs upon entering this agreement, but knows that ‘AHA’ will do their best to help the ‘Student-athlete’ achieve their academic and athletic objectives.
The ‘Student-athlete’ understands and accepts that he/she will have to perform both athletically and academically if he/she expects a college/university to recruit him/her and provide financial assistance in terms of scholarships and/or financial aid.
The ‘Student-athlete’ understands that he/she can request other services offered by ‘AHA’ for an additional cost, such as workout programs, on-ice skills programs, highlight video production, game film analysis, and more, as agreed to between both parties. The ‘Student-athlete’ understands and agrees that ‘AHA’ is not responsible for any injuries that the ‘Student-athlete’ may sustain while partaking in any of the additional services offered by ‘AHA’.
Should either party wish to terminate this agreement, it must be done in writing by email. ‘AHA’ will terminate this agreement if the ‘Student-athlete’ acts in any illegal, unethical, and/or damaging manner as determined by ‘AHA’ in its sole and absolute discretion, to which ‘AHA’ will not be responsible for any of the ‘Student-athlete’s’ actions. ‘AHA’ will not provide any refunds to the ‘Student-athlete’ if this agreement is terminated or under any other circumstance.
The ‘Student-athlete’ shall indemnify and save harmless ‘AHA’ from and against any and all claims, actions, damages, liability and expense in connection with any damages arising from or out of any occurrence related to this agreement or occasioned wholly or in part by any act or omission of ‘AHA’.
Any section of this agreement which is, or becomes illegal, invalid or unenforceable shall be severed here from and shall be ineffective to the extent of such illegality, invalidity or unenforceability and shall not affect or impair the remaining sections hereof which shall continue in full force and effect.
This agreement represents the entire agreement between the parties and the provisions of this agreement shall supersede all prior oral and written commitments, contracts, and understandings with respect to the subject matter of this agreement. This agreement may be amended only by mutual written agreement between both parties. This agreement shall be covered by the laws of Quebec, Canada.
